Elizabeth Edwards Wants Daughter to Assume Guardianship Over Younger Children

Elizabeth Edwards, estranged wife of former presidential candidate John Edwards, has reportedly been looking into whether the couple's eldest daughter, Cate, can obtain legal guardianship over her two younger siblings. Cate is 28-years-old, while her Jack and Emma Edwards are 10 and 12, respectively.

John Edwards recently acknowledged an affair with former campaign videographer Rielle Hunter, as well as admitted to being the father of her two-year-old daughter. Elizabeth Edwards, who was originally diagnosed with breast cancer in 2004, suffered a relapse in 2007 when the cancer returned.

Some reports have indicated that Elizabeth's inquiries into child guardianship are part of a plan to prevent John from having custody of the children in the event of her death. She has denied these claims.

Even if an attempt was made to have Cate Edwards established as legal guardian of the two younger children, legal experts have voiced doubt that such a move would succeed. It seems unlikely that a court would deny custody to the surviving parent following the death of the other. Such a decision would not likely be in the children's best interests.

Of course, the court may take exception to this if John Edwards is found to be unfit as a parent. The former senator is currently being investigated by a grand jury to determine whether or not he passed campaign funds on to Rielle Hunter.

Critics of John have pointed out that, between potential legal trouble and a new baby with Hunter, it is unlikely John would have much time for the children he has with Elizabeth.
